If any residential care home for the elderly (RCHE) fails to comply with the requirements set out in the Residential Care Homes (Elderly Persons) Ordinance (Cap. 459, Laws of Hong Kong), the Residential Care Homes (Elderly Persons) Regulation (Cap. 459 Sub. Leg.A) or the Code of Practice for Residential Care Homes (Elderly Persons), depending on the severity of the irregularities, the Social Welfare Department may consider issuing warning letters, giving directions for remedial measures, or initiating prosecution actions.
The Department is going to publicise the warning records of RCHEs with a view to achieving a more transparent monitoring mechanism.
